The concept of litigation control may seem daunting, or even impossible, due to our lawsuit happy industry, but it is actually quite simple. Let’s not fool each other, the amount of law suits may not diminish, but our programs reduce the amount of claimed defects and therefore the cost of repair.
The program includes review of drawings, specifications, contracts, and meetings with AIA/Eng. at a minimum. Depending on which activities we are retained to analyze, we develop specific tasks for each. All of our work efforts seek to reduce/minimize or eliminate claims after project completion.
One of our better success stories involved an 18 building condominium project (phase 2). We analyzed all structural elements and foundations. During the 12 month project, we analyzed work as it occurred, requiring changes/corrections as necessary. We recorded notes, photos and other documentation which was used to successfully defend the framing and concrete. Phase one claim was $9 million, while Phase two was $1 million for activities other than structural and framing.
